Basement excavation next door: the questions to ask before anyone digs

Mini excavator digging a trench in a back garden

Key Takeaways

  • A basement excavation can combine vibration, settlement, heave, removal of support and groundwater changes, so neighbouring buildings can be damaged even when the work is done well.
  • A public liability policy needs fault; non-negligent liability cover stands behind the building owner’s obligation to the neighbours when there is none.
  • Adjoining owners should ask, in writing, for a schedule of condition, the contractor’s public liability details, and confirmation of non-negligent liability cover and its limit.
  • The limit should be at least the full combined reinstatement cost of the neighbouring properties that could be damaged by the works.

Nothing in ordinary construction concentrates risk to the neighbours quite like a basement. Excavation below the level of adjoining foundations, dewatering that changes what the ground beneath the street is doing, months of vibration, and all of it in terraces where the party wall is literally shared structure. It is no accident that the insurance clause built for damage without negligence gets specified on basement jobs more than anywhere else. This article is for both houses: the owner watching the hoarding go up next door, and the owner or developer planning the dig.

Why basements are the highest risk

The mechanisms that damage neighbouring buildings during construction are vibration, settlement, heave, removal of support and changes to groundwater, and a basement excavation can involve all five at once, over months, within metres of someone else’s foundations. Even a project executed to a high standard moves ground; that is the nature of taking a large volume of earth out from under a street of old buildings. This is exactly why negligence is so often the wrong lens. When cracking appears three doors down, the engineering may have been faultless, and a public liability policy, which needs fault, may have nothing to respond to. The obligation to the neighbour remains.

If the basement is going in next door

You cannot usually stop lawful works, but you are entitled to be protected, and the party wall process is where that protection is organised. The questions worth asking, politely and in writing, before the dig starts: Will there be a full schedule of condition of my property, inside and out? Who is the contractor, and what public liability cover do they carry? And is non-negligent liability cover in place for these works, and at what limit? As a guide, the limit should be at least the full combined reinstatement cost of the neighbouring property or properties that could be damaged by the works, so that the cover is sufficient if they ever needed to be reinstated in full.

If you are the one digging

For a developer or homeowner commissioning a basement, the insurance arrangements are part of the engineering. The works and the existing structure need cover, which for a domestic project usually means a single project policy of the kind our renovation insurance page describes. The obligation to the neighbours needs non-negligent liability cover, at a limit set from the realistic worst case on that street rather than from the contract minimum. If your contractor claims their annual programme includes it, ask to see the extension and its limit, and check the works you are doing fall inside any qualifying conditions; where the annual programme will not stretch, a standalone project-specific policy fills the gap, which is a placement we make regularly. Ensure you serve the notices properly, fund a thorough schedule of condition and keep the neighbours informed. Most basement disputes are not really about cracks; they are about people who felt ignored until the cracks appeared.

We arrange non-negligent liability cover for individual basement and structural projects and as extensions to contractors’ annual programmes, and we review the contract insurance schedule so the cover placed actually matches what the contract demands. Our non-negligent liability page has the full detail.

I was very pleased with the service from Daines Kapp. Donna was incredibly helpful throughout the whole process, always patient, knowledgeable and responsive with all my queries. She made the whole experience straightforward and reassuring, particularly as I had very little knowledge of this area. A really positive experience overall.

DAINES KAPP are by far the best insurance brokers I have ever dealt with (and I have had some bad experiences with the insurance industry, as many have). It was refreshing to work with George and Obed especially. They listened to the requirements, worked hard to iron out any policy wording issues with the insurance company and were very easy to communicate with (no waiting on phone calls). Their fees are very reasonable and they get the job done quickly. HIGHLY RECOMMENDED!!
